Acceptance of Terms

By accessing or using PulseMon ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

Description of Service

PulseMon provides IoT device monitoring through MQTT heartbeat subscriptions and HTTP health checks, with alerting via email and Slack. The Service is provided on a subscription basis with Free, Starter, and Pro tiers.

Account Responsibilities

• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the Service or servers connected to it
• Use the Service to monitor devices you do not own or have authorization to monitor
• Resell or redistribute the Service without our written consent
• Exceed the device limits of your subscription plan through circumvention

Subscription & Payments

Paid plans are billed monthly. You may upgrade, downgrade, or cancel your subscription at any time. Downgrades take effect at the end of the current billing period. Refunds are not provided for partial months of service.

Free Tier

The Free tier allows monitoring of up to 5 devices at no cost. We reserve the right to modify Free tier limits with 30 days' notice. Free tier accounts inactive for more than 90 days may be deleted.

Service Level Agreement

We target 99.9% uptime for paid plans. Scheduled maintenance windows will be communicated in advance. We are not liable for downtime caused by factors outside our control, including internet outages, third-party service failures, or force majeure events.

Data Ownership

You retain all rights to the data you submit to the Service. We claim no ownership over your device data, configurations, or monitoring results. Upon account deletion, your data will be permanently removed within 30 days.

Limitation of Liability

The Service is provided "as is" without warranties of any kind. PulseMon shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold PulseMon harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

Termination

We may suspend or terminate your account if you violate these Terms. You may terminate your account at any time. Upon termination, your right to use the Service ceases immediately.

Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or prominent notice on the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
